These Terms of Service govern your access to and use of www.shopella.com.au, including purchases made through our online store.

In these Terms, “Shopella”, “we”, “our” and “us” refer to Shopella. “You” and “your” refer to any visitor, customer or person using our website.

By accessing our website or placing an order, you agree to these Terms. Please read them together with our:

1. About Shopella

Shopella is an Australian-based online fashion boutique located in Sydney, Australia.

We offer selected products from recognised European and international fashion labels. Our range may include:

  • New designer and contemporary fashion
  • Clothing, footwear and accessories
  • Selected pre-loved or pre-owned branded products

Products may be supplied or dispatched directly by international suppliers, distributors or fulfilment partners.

2. Eligibility to Purchase

You must have the legal capacity to enter into a binding agreement to place an order.

If you are under 18 years of age, you may use our website and purchase products only with the involvement and consent of a parent or legal guardian.

You agree that all information provided when placing an order is complete, current and accurate.

3. Acceptable Use of Our Website

You must use our website only for lawful purposes.

You must not:

  • Use the website for fraudulent or unlawful activity
  • Attempt to gain unauthorised access to our systems or customer accounts
  • Introduce viruses, malware or other harmful code
  • Scrape, copy or automatically extract website content without permission

4. Product Information

We take reasonable care to ensure that product descriptions, photographs, measurements, prices and availability information are accurate.

However:

  • Colours may appear differently depending on your screen or device.
  • Sizing may vary between brands and countries.
  • Product packaging may vary between suppliers or warehouses.
  • Minor design or packaging variations may occur.
  • Products may sell out or become unavailable before our systems update.

Any variation must still be consistent with the product’s description and applicable consumer guarantees.

Please review the product description, sizing information, condition information and images before ordering.

5. New and Pre-Loved Products

Shopella may sell both new and pre-loved or pre-owned products.

Pre-loved products will be identified on the relevant product page. Their description may include available information about:

  • Condition
  • Previous use
  • Marks or signs of wear
  • Included accessories
  • Packaging
  • Product age or season

Reasonable signs of previous use that were clearly disclosed before purchase are not considered undisclosed faults.

Nothing in this section limits your rights where a pre-loved product is faulty, unsafe, misdescribed or otherwise fails to meet a consumer guarantee.

6. Authenticity

Shopella sources products through selected suppliers and distributors that represent their products as genuine and authentic.

Shopella does not knowingly sell counterfeit, replica or imitation products.

If you have concerns about a product’s authenticity, contact info@shopella.com.au with your order number and clear photographs of the product, labels, tags and packaging.

We will investigate the matter with the relevant supplier or distributor.

7. Pricing and Currency

Unless otherwise stated:

  • Prices are displayed in Australian dollars.
  • GST is included where applicable.
  • Shipping, customs duties and other applicable charges may be added separately.
  • The total payable amount will be displayed before you submit your order.

We may change product prices and promotions at any time. Changes will not affect an order already accepted by us.

If an obvious pricing or listing error occurs, we may contact you before dispatch to offer the choice of:

  • Proceeding at the correct price, or
  • Cancelling the affected item for a full refund

We will not charge an increased price without your agreement.

8. Orders and Acceptance

After placing an order, you will normally receive an automated confirmation email. This confirms that we have received your order but does not necessarily confirm that every item is available or has been dispatched.

An order may be declined or cancelled before dispatch where reasonably necessary, including where:

  • The product is unavailable
  • The supplier cannot fulfil the order
  • There is an obvious pricing or description error
  • Payment cannot be authorised
  • Fraud or unauthorised activity is suspected
  • Delivery is unavailable to the supplied address
  • The order would breach a law, sanction or courier restriction

If we cancel an order after payment has been received, we will refund the affected amount to the original payment method.

9. Payment

Payment must be made using a method offered at checkout.

Available payment methods may vary according to your location, device and the payment services currently enabled on our store.

Payments are processed through Shopify Checkout and the relevant payment provider. Shopella does not ask customers to send full card details by email, telephone or social media.

You confirm that you are authorised to use the selected payment method.

We may delay or cancel an order where payment is declined, reversed, disputed or identified as potentially fraudulent.

10. Shipping and Delivery

Shopella delivers throughout Australia and to selected international destinations available at checkout.

Some products may be dispatched from international warehouses, and items in the same order may arrive in separate parcels.

The shipping methods, charges and delivery information displayed at checkout apply to your order.

Delivery periods are estimates unless expressly stated otherwise. Delivery may be affected by supplier processing, customs, couriers, public holidays, severe weather and other events outside our reasonable control.

We will still provide an appropriate remedy where paid goods cannot be supplied within an agreed or reasonable time, as required by law.

11. Delivery Information

You are responsible for providing a complete and accurate:

  • Recipient name
  • Delivery address
  • Email address
  • Telephone number
  • Apartment, unit or access information

Contact us immediately if you notice an error.

We will try to update the information before dispatch, but changes cannot be guaranteed once processing or fulfilment has begun.

Where a parcel is returned because customer-supplied information was incorrect or incomplete, reasonable return or redelivery costs may apply where permitted by law.

12. Customs, Duties and Import Charges

International orders may be subject to duties, taxes, brokerage fees or other charges imposed by the destination country.

Unless specifically collected at checkout, these charges are generally payable by the recipient.

Shopella does not control charges imposed by foreign customs authorities.

If a parcel is refused or returned because applicable import charges were not paid, reasonable return, customs or handling costs may be deducted from an eligible refund where permitted by law.

13. Changes and Cancellations

Orders may begin processing shortly after checkout.

Contact info@shopella.com.au immediately if you wish to request a change or cancellation.

We will try to assist, but a cancellation or change cannot be guaranteed after processing or fulfilment has begun.

If the order cannot be cancelled, you may request a return after delivery in accordance with our Returns & Refunds Policy.

14. Returns and Change of Mind

Eligible products may be returned for change of mind within 14 days of delivery, subject to our Returns & Refunds Policy.

The customer is generally responsible for approved change-of-mind return shipping costs.

Do not send a return before receiving authorisation, the correct return address and shipping instructions from Shopella.

Products marked Final Sale or certain pre-loved or hygiene-sensitive products may be excluded from voluntary change-of-mind returns where the exclusion is clearly disclosed before purchase.

These exclusions do not remove any rights relating to faulty or misdescribed products.

15. Faulty, Damaged, Incorrect or Misdescribed Products

Products sold by Shopella come with consumer guarantees that cannot be excluded under the Australian Consumer Law.

Contact us if a product:

  • Arrives damaged
  • Is faulty or unsafe
  • Is the wrong product
  • Is significantly different from its description
  • Is not of acceptable quality
  • Is not reasonably fit for its normal or disclosed purpose

The appropriate remedy depends on whether the problem is major or minor. Remedies may include repair, replacement, refund or another remedy required by law.

The 14-day voluntary change-of-mind period does not impose a fixed deadline on your rights relating to faulty goods.

16. Promotions and Discount Codes

Promotions and discount codes may be subject to additional conditions, including:

  • Start and end dates
  • Minimum spending requirements
  • Product or brand exclusions
  • Customer or location restrictions
  • Single-use limits
  • Restrictions on combining offers

These conditions will be shown with the relevant promotion.

Unless required by law, discount codes cannot be applied retrospectively to completed orders.

We may cancel or correct a promotion affected by an obvious technical, pricing or publication error, but we will not alter an accepted order without contacting you.

17. Reviews and Customer Content

Where you submit a review, photograph, comment or other content, you confirm that:

  • It reflects your genuine experience
  • It is accurate and lawful
  • You have permission to submit it
  • It does not infringe another person’s rights
  • It does not contain abusive, defamatory, discriminatory or misleading material

You retain ownership of your content.

By submitting it, you give Shopella a non-exclusive, royalty-free licence to display and use it in connection with our website, products and marketing, unless you withdraw permission where legally permitted.

We may remove content that breaches these Terms or applicable law.

18. Intellectual Property

The Shopella website and its original content, branding, graphics, layout and design are owned by or licensed to Shopella.

Brand names, product images, logos and trademarks belonging to designers, suppliers or other third parties remain the property of their respective owners.

You may not copy, reproduce, distribute, alter, publish or commercially exploit website content without permission from the relevant rights holder.

Nothing on the website grants ownership of any trademark, copyright or other intellectual property.

19. Third-Party Services and Links

Our website may use or link to third-party services, including Shopify, payment providers, suppliers, couriers, social-media platforms and external websites.

Third-party services may be governed by their own terms and privacy policies.

Shopella is not responsible for independent third-party websites that we do not own or control. However, using suppliers, couriers or other service providers does not remove Shopella’s responsibilities to customers under applicable consumer law.

20. Website Availability

We aim to keep the website accurate, secure and available.

However, access may occasionally be interrupted by:

  • Maintenance
  • Updates
  • Technical faults
  • Security incidents
  • Internet or hosting failures
  • Circumstances outside our reasonable control

We may modify, suspend or discontinue a website feature where reasonably necessary.

Nothing in this section limits liability that cannot lawfully be excluded.

21. Liability

To the maximum extent permitted by law, Shopella is not liable for loss caused solely by:

Your remedies are not limited solely to the product purchase price where applicable law provides additional rights.

Personal information may be processed by service providers involved in operating the store, processing payments, fulfilling orders, delivering parcels, preventing fraud and providing customer support.

The remaining provisions will continue to apply.

25. Governing Law

These Terms are governed by the laws of New South Wales and the Commonwealth of Australia.

You submit to the courts that have jurisdiction in New South Wales, subject to any mandatory rights you have under the laws of your location.
